Liability waiver and fitness to play

By ticking the waiver box in the entry form, and again when you sign at check-in, you confirm three things:

• You are physically fit to play competitive doubles pickleball over two days in a hot climate.
• You know of no medical condition that makes playing unsafe for you, or you have discussed it with your doctor and been cleared to play.
• You take part voluntarily and at your own risk.

If your health changes between registering and the tournament, tell the desk. We would rather move you out of a draw than have you collapse on court.

Pickleball is a fast sport played on a hard surface. Injuries happen. The risks include, and are not limited to:

• Sprains, strains, fractures, cuts and impact injuries from falls, collisions with a partner or opponent, or being struck by a ball or a paddle
• Overuse injuries from playing several matches in a weekend
• Heat exhaustion, heat stroke and dehydration. Guanacaste in December is hot and dry, and matches run back to back
• Cardiac events brought on by exertion
• Slips on a court surface, in walkways, around the pool area or in the parking area
• Loss of or damage to personal property

You accept these risks as part of taking part.

To the fullest extent permitted by Costa Rican law, you release Lotus & Lime Tournaments, Finca Escondida Racquet & Social Club, Lotus & Lime, the tournament sponsors, and the directors, staff, referees, medical personnel and volunteers of each of them, from claims for injury, illness, loss or damage arising from your participation, from your presence at the venue, or from your travel to and from the event.

This release has limits. It does not cover, and does not attempt to cover, death or personal injury caused by negligence, gross negligence, wilful misconduct, or any liability that cannot lawfully be excluded or limited in Costa Rica. If a court finds part of this section unenforceable, the rest stands.

You consent to first aid and emergency medical treatment being given to you at the venue if you are unable to consent at the time, and to being transported to a medical facility if that is judged necessary.

You are responsible for the cost of any medical treatment, ambulance or evacuation. The tournament does not provide medical insurance.

We ask for an emergency contact in the entry form. Give a person who can actually be reached during the tournament weekend, and tell them you listed them. We use that contact only in an emergency.

You are responsible for your own health, accident and travel insurance. Visiting players should check that their policy covers competitive amateur sport in Costa Rica.

The tournament carries no policy that insures a player against their own injury.

Players under 18 on the day of play may take part only if:

• A parent or legal guardian accepts this waiver on their behalf and signs the paper waiver at check-in.
• That parent or guardian is reachable by phone throughout the days the player is scheduled to play.

The tournament desk may ask for identification. A minor whose guardian has not signed will not be put on court.

The courts are covered, so rain does not stop play, but heat is real. Bring more water than you think you need. There is water on site and Lotus & Lime is open through the weekend.

The Tournament Director, the Head Referee or on-site medical personnel may stop a match or withdraw a player at any time on safety grounds. That decision is final and carries no refund beyond what section 6 of the terms of entry already gives you.

In extreme heat the Tournament Director may shorten games to 7 points, as set out in the tournament rules.

Every player signs a paper waiver at check-in before their first match. It says the same thing as this page. The online tick and the signature at the desk are both part of the same acceptance, and the signature at the desk is the one that lets you on court.

If you refuse to sign, you cannot play, and the refund dates in the terms of entry apply as they would to any withdrawal.

This waiver is governed by the law of Costa Rica and read together with the terms of entry, the tournament rules and the privacy and media policy.
